Disrepairs?

A Claim for Housing Disrepair Against a Landlord Or Housing Association? 

In simple terms, a housing disrepair claim  raised when the condition of a rented property, either through social housing or a private landlord, has deteriorated in a significant and negative way since occupation.

This is usually damage or deterioration to the exterior that is connected to or forms part of the actual dwelling or interior of the house, structure, grounds, or common parts in case of flats.

What Are You Entitled to For Your Housing Disrepair Claim?

There are three things that can be awarded to the tenant in a housing disrepair claim, these include:

  • repairs;

  • compensation;

  • legal costs;

A lot of factors influence the compensation that you might receive. Compensation will factor ‘pain, suffering and loss of amenity’ caused by residing in a house with a disrepair issue or having to vacate it. The rent of the property is also used as a basis to calculate the compensation as are any costs you have incurred to restore the property for more comfortable living.

What Do Our Survey Experts Inspect

A surveyor will visit your home and compile a report which will be sent to your Landlord and/or acting Legal Adviser. As such our Expert Surveyor will inspect the following elements of the house and report on the action of disrepairs claim according Fitness for Human Habitation framework:.

  • Damp
    Evidence of damp on your walls or in your bathroom/kitchen?

  • Mould Growth
    Can you smell mould growing in damp places in your home?

  • Condensation:
    Evidence of condensation to walls and ceilings

  • Water Pipes
    Defective pipework connected to baths, sinks, toilets?

  • Heating
    Evidence that central heating not been working for some time? Is your hot water reliable?

  • Gutters
    Evidence of defective gutters blocked, leaking or overflowing?

  • Electrical Wiring
    Evidence of defective, exposed or loose wiring?

  • Vermin Infestations
    Evidence of rats/mice, pests regularly in the house

  • Roof
    Evidence of your roof leaking? Are there slipped roof tiles?

  • Drains
    Evidence of drains giving off an odour because they are blocked or leaking?

  • Structure & Exterior
    Inspection of external pipes for supplies of water, gas, electricity and sanitation. Is the structure of a good state of repair?

  • Windows
    Inspection of internal and external windows secure and safe? Are they generally in a good state of repair and thermally efficient?

  • General Ill Health
    Proof of ill health/personal injury include asthma; coughs and colds; depression; anxiety; gastro-intestinal problems and carbon monoxide poisoning.
